Samtykkeerklæring til Phase Ones brug af billeder

Herunder er de “model release” udformet af Phase One A/S, og er den aftale som Phase One A/S normalt benytter sig af.

I the undersigned individual and model (“Model”) explicitly grant to Phase One A/S, (CVR no. 17889699), Roskildevej 39, 2000 Frederiksberg, Denmark (“Phase One”) a non-exclusive, royalty free, fully-paid up and worldwide license to use, print, copy, modify, combine, distribute, display, communicate to the public, publish and otherwise use the photographs and videos referred to below, in which I am included, in any media without any restrictions of whatsoever nature for any current and future business activities of Phase One, including without limitation activities such as the following:

·     Any use on websites incl. online/digital galleries etc.

·     Any use as e-blasts and web banners etc.

·     Any use on any current or future social media (e.g. Facebook, Google+, Twitter, YouTube, Pinterest) etc.

·     Any use in connection with tradeshows, demonstrations, conferences, seminars

·     Use in connection with or as part of any promotional material, third party PR and press material etc.

·     Any other use in connection with Phase One’s current or future business activities

Phase One is entitled to sublicense the use of the photographs and videos referred to below to its affiliates and associated companies, distributors, resellers and other third parties engaged by or otherwise used by Phase One in connection with any of its business activities.

Phase One is granted the right of usage as contemplated herein for a period of up to four (4) years from the date of my signature below on this release. I understand that the photographs and video may be altered in the sole discretion of Phase One and I waive the rights to approve any altered versions and use of the photographs and videos. I understand that I do not own the copyright of the photographs or the videos.

Notwithstanding the above, following expiration of the License Term, Phase One is forthwith granted a non-exclusive, royalty free, fully-paid up, perpetual and non-terminable right to keep a digital archive containing any and all published material, including the delivered Material for archival purposes including for the purpose of documentation and inspiration. The Model is not entitled to assert any claims of whatsoever nature against Phase One regarding Phase One’s use of the photographs and videos and the Model acknowledges and accepts that any claims must be made against the photographer which engaged the Model including without limitation any claims by the Model for remuneration, damages and/or any other claims. 

Any disputes shall be governed by and construed in accordance with Danish law and shall be subject to the exclusive jurisdiction of the ordinary Danish courts.
